Pre-Made Content Warranty Policy:
Variation Media will abide by Australian consumer law and provide customers with a repair, a refund, or a replacement if the product is faulty or damaged. In addition, Variation Media has its own refund policy as outlined below.
The goods sold, whether physical or digital:
- will be a quality consistent with the product description;
- match any description or sample given to the consumer in promotional material;
- be free from defects and faults.
Variation Media understands that when goods are sold a contract is entered into with the consumer and, should the business fail to meet this obligation, a refund or replacement may be provided.
The consumer also understands that:
- the product is licenced for viewing following Variation Media’s Content Licencing Policy;
- the cancellation of physical goods may only be done before they are shipped;
- Variation Media is not obligated to refund products that are not faulty and hold no responsibility to give refunds if you did not enjoy the content;
- the ratings applied to content comply with Australian media ratings;
- the consumer is solely responsible for moderating their viewing experience and Variation Media is not responsible for distress caused by viewers who did not pay careful attention to, or understand, the applied rating.
Media Creation Service Agreement:
Variation Media will abide by Australian consumer law and provide customers with a repair, a refund, or a replacement if the service provides a misleading, faulty, or damaged end product. In addition, Variation Media has its own refund policy as outlined below.
Variation Media acknowledges that:
- Variation Media is obligated to carry out all services with skill and care;
- Variation Media be responsible for ensuring materials provided as part of this service are fit for the purpose;
- the service provided will be of an appropriate quality for the purpose;
- if the outline is not followed appropriately the product will be considered faulty;
- any deadlines must be met;
Should Variation Media fail to meet any of these obligations the service may have to be repeated or refunded. It is also acknowledged that the consumer may also be able to claim compensation for expenses incurred as a result, such as loss or damage. Variation Media may have to bear this cost.
The consumer also understands that:
- when requesting use of Variation Media’s services, the appropriate Outline Template must be followed;
- if the outline is followed appropriately Variation Media has no obligation to refund as the product is not considered faulty;
- changes to the product outline after the start of the work, or the request to change parts of the product outside of the pre-agreed outline, may not be able to be fulfilled or may incur additional fees if they are;
- cancellation of the service by the consumer will only provide a partial refund that will be determined on a case-by-case basis and reflect the amount of work the service has already completed, and Variation Media is not required to provide any refunds if the service is more than 50% completed and all deadlines have been met.
Variation Media reserves the right to refuse service for any reason without explanation.
